DonorAid® – It’s More Rewarding Loyalty Terms & Conditions

DonorAid Pty Ltd Cardholders Terms & Conditions

These terms and conditions govern the DonorAid – It’ More Rewarding loyalty program and contain important information, including disclaimers and limitations of liability. Please see clause 13.1 for definitions of capitalised terms.

1. Application of these Terms

  1. You agree to be bound by these Terms by checking the “I agree to the Terms and Conditions of Use of the DonorAid – It’ More Rewarding loyalty program” box when registering for participation in the Program on the DonorAid Website.
  2. You agree that you have the necessary capacity to enter into a binding legal contract.
  3. DonorAid may from time to time review and update these Terms. Your use of the Program will be governed by the most recent Terms posted at the DonorAid Website. By continuing to use the Program, you agree to be bound by the most recent Terms. It is your responsibility to check the DonorAid Website regularly for updated versions of the Terms. DonorAid will provide you with at least 14 days’ prior notice of any material changes to the Terms. Notice of any material change to the Terms will be at DonorAids’ option be either published on the DonorAid Website or sent to the email address registered with the Program.
  4. The use and operation of your MasterCard or Visa Card will also be subject to separate terms and conditions provided to you by your Card Issuer.
  5. You agree that you have not relied on any representation, description, illustration or specification that is not expressly stated in these Terms.
  6. If you do not accept these Terms, you will not be entitled to use the Program.

2. The Program

  1. The Program allows you to earn a Cash Reward when using your MasterCard or Visa Card with DonorAid Participating Merchants.
  2. In Real-Time of purchase, or upon a Qualifying Transaction being identified by DonorAid, DonorAid will display the Reward in the Cardholders e-Wallet in the Cardholders DonorAid Account.
  3. DonorAid will forward any Cardholder Donation to a separate e-Wallet for the Cardholders nominated Charity, Church, Club or Organisation displayed in the Cardholder DonorAid Account.
  4. The total amount above $100 in the Cardholder’s Charity, Church, Club or Organisation’s e-Wallet will be forwarded to the Cardholders nominated Charity, Church, Club or Organisation within fourteen (14) days of the end of each calendar month.
  5. If the total amount is less than $100, it will roll-over till the next month.

3. Registering for the Program

  1. In order to register for the Program and remain registered for the Program, you must:
    1. (a). be a member of DonorAid – It’ More Rewarding loyalty program;
    2. (b). provide certain mandatory User Information as required by DonorAid;
    3. (c). register a valid MasterCard or Visa Card to your DonorAid Account;
    4. (d). be an authorised holder and user of the MasterCard or Visa Card; and
    5. (e). fully and validly complete the registration process.
  2. You may not register more than 5 MasterCard or Visa Cards to a single DonorAid Account. Your MasterCard or Visa Card must be issued by an Australian financial institution.
  3. You must maintain and promptly update the User Information to keep it true, accurate, current and complete. It must include a current email address.
  4. Your DonorAid Account will be active immediately upon registration in accordance with clause (9) provided that any information you have supplied is correct and valid.
  5. You represent and warrant that:
    1. you are the individual identified in the registration
    2. and verification process;
    3. you are an authorised user of the MasterCard or Visa Card; and 3. the User Information that you have provided to DonorAid Pty Ltd is true and correct.
  6. If you provide any User Information that DonorAid believes to be untrue, inaccurate, not current or incomplete, DonorAid may suspend or terminate your DonorAid Account and remove your access to the Program.
  7. If you provide any incorrect information or details (whether fraudulently or by mistake), you may not be entitled to earn Cash Rewards.
  8. When using the Program, you are responsible for maintaining the confidentiality of your User Information, and for restricting access by third parties to your DonorAid Account. You agree to
  9. be liable if your User Information is used by an unauthorised person or for an unauthorised purpose. You are fully responsible for all activities that are conducted under your DonorAid Account.
  10. If you believe that any of your User Information has been compromised, lost or misplaced, you must contact DonorAid immediately.

4. Special conditions of use

  1. In order to be eligible for a Cash Reward, you must:
    1. make a purchase with a Participating Merchant;
    2. use a MasterCard or Visa Card that is registered to a DonorAid Account;
    3. if you make a purchase using electronic funds transfer at a physical over the counter point of sale, online or mobile, ensure that you use your registered MasterCard or Visa credit card, debit card, or prepaid- reloadable card; and
  1. You agree that the Cash Reward can only be applied to your DonorAid Account registered to your MasterCard or Visa Card. If a different credit, debit or prepaid-reloadable card is used which is not registered to a DonorAid Account, no Cash reward will be earned.
  1. You agree that you have had the option to nominate in your DonorAid Account an amount to be donated to a Church, Charity, Club or Organisation of your choosing and this amount above $100 in the Cardholder’s Church, Charity, Club or Organisation will be forwarded to that Church, Charity, Club or Organisation within fourteen (14) days of the end of each calendar month.
  1. If the total amount is less than $100, it will roll-over till the next month.
  2. Your DonorAid Account will retain a copy of both the tax receipt and the MasterCard or Visa card receipt for each eligible transaction to which these Terms apply as these receipts may be needed for a taxable deduction claim or as evidence in the event of a dispute or to verify qualifying purchases.
  1. All donations over $2 to a registered Deductable Gift Recipient is tax deductable.

5. Participating Merchants

  1. You may only receive a Cash Reward when using the Program with Participating Merchants.
  2. Participating Merchants are subject to change. A full list of the current Participating Merchants can be found at the DonorAid -It’s More Rewarding Website and App. It is your responsibility to check the DonorAid – It’s More Rewarding website and App regularly to ensure that you are aware of any changes to the Participating Merchants and Cash Reward offerings.
  3. All transactions using your MasterCard or Visa card are with the Participating Merchant and not with DonorAid. DonorAid doesn’t have any responsibility or obligation for the transaction with the Participating Merchant. DonorAid does not endorses or warrants any goods or services of Participating Merchants.

6. Cash Reward

6.1 What is a Cash Reward?

The Cash Reward is not property and may not be, sold, held on trust or inherited.

6.2 Receiving a Cash Reward

  1. The Cash Reward is calculated on the amount of Australian dollars charged to your MasterCard or Visa card, less any amounts referred to in clause 6.2(c).
  2. The Cash Reward to which you are entitled in any given transaction may depend on the Cash Reward percentages for each Participating Merchant. Percentages can be found at the DonorAid Website.
  3. The Cash Reward will not be earned in respect of the following amounts that may be charged to your MasterCard or Visa card:
    1. government charges (excluding GST payable in connection with the purchase of goods or services on which you earn a Cash Reward);
    2. interest and other bank fees and charges including without limitation foreign exchange conversion fees and reversals (and any GST payable on any of these);
    3. Excluded Transactions;
    4. balance transfers; and
    5. payments in which you do not use payments made through the Bpay® Electronic Payments Scheme.
  4. Subject to clauses 6.2(e) and 6.2(f), your DonorAid account will receive the Cash Reward to which you are entitled in real-time on the date of which the relevant transaction is settled by your Card Issuer and the Participating Merchant.
  5. You acknowledge that it is the responsibility of your Card Issuer and the Participating Merchant to settle transactions. This will occur in real-time when the transaction takes place.
  6. You may not receive a Cash Reward if:
    1. your MasterCard or Visa Card is cancelled for any reason;
    2. your MasterCard or Visa Card has been lost or stolen (until the registered lost or stolen card has been removed from your DonorAid Reward Account and has been replaced and you update your DonorAid Account details in accordance with clause 6.2(g);
    3. your MasterCard or Visa Card has an expiry notification and you have not renewed your MasterCard or Visa Card (until you renew your MasterCard or Visa Card and update your DonorAid Account details in accordance with clause 6.2(g); or
    4. DonorAid reasonably suspects that you have breached these Terms or the terms and conditions associated with your MasterCard or Visa Card in any way.
    5. In order to continue using the Program, you must ensure that your DonorAid Account details reflect your current MasterCard or Visa Card number and expiry date. Replacement MasterCard or Visa Cards must be re- registered to your existing DonorAid Account. In the event that the circumstances referred to clauses 6.2(f)(ii) or 6.2(f)(iii) occur, or if your MasterCard or Visa Card is cancelled and you obtain a new MasterCard or Visa Card, you must
  7. update your MasterCard or Visa Card number in your DonorAid Account (following the procedure on the DonorAid Website).
  8. Any changes to your DonorAid Account (including to your User Information and MasterCard or Visa Card number) will be updated by DonorAid within 5 days.

6.3 Monitoring your DonorAid Account and using Cash Reward

Your Cash Reward balance will be visible when you have logged into your DonorAid Account
through the DonorAid Website or any desktop or mobile application made available by
DonorAid.

6.4 Refunds or returns and disputed transactions

  1. Refunds or returns of goods or services purchased by you will trigger a reversal of the relevant Cash Reward associated with that transaction.
  2. Where a refund or return of goods or services occurs after a Cash Reward has been claimed as a Cash Settlement, the Cash Settlement amount will become a debt due and payable from you to DonorAid immediately (Debt). A reversal of the relevant Cash Reward associated with that transaction will occur, your DonorAid Account will be debited by the relevant reversed Cash Reward, and the debit will be offset against other Cash Reward in your DonorAid Account including Cash Reward you may earn in the future. DonorAid may also recover the balance of the Debt from you directly and immediately upon request.
  3. If your MasterCard or Visa Card is credited in connection with a disputed transaction, DonorAid will adjust your Cash Reward total by deducting any Cash Reward that was earned in connection with the disputed (or subsequently reversed) transaction within 30 days depending on the terms and conditions in relation to your MasterCard or Visa Card.
  4. If you fail to comply with clause 6.4(2):
    1. DonorAid may suspend your account immediately;
    2. DonorAid may liaise with your Card Issuer and other relevant third parties in order to recover the Debt; and
    3. DonorAid may take any other necessary action in order to recover the Debt.

6.5 Transferring Cash Reward

  1. Cash Reward can be transferred from the MasterCard or Visa cardholders DonorAid Account to their MasterCard or Visa card account or to a nominated church, charity, club or organisation identified in their DonorAid Reward Accounts.
  2. Cash Settlements cannot be settled to an account other than the MasterCard or Visa Card Account.
  3. Replacement MasterCard or Visa Cards must be re-registered to your existing DonorAid Reward Account in accordance with clause 6.2(g). Please log on to your DonorAid Account to register a replacement MasterCard or Visa Card.

7. Termination or expiry of the Program

  1. DonorAid may suspend your DonorAid Account and your participation in the Program and/or
  2. terminate these Terms and Conditions by giving you notice with immediate effect that you have breached these Terms.
  3. If DonorAid terminates these Terms and your DonorAid Account in accordance with clause 7(a), all of your Cash Reward will vest in DonorAid Pty Ltd.
  4. You may terminate your DonorAid Account for any reason by selecting the “close account” link within your DonorAid account.
  5. Any unused Cash Reward at the end of this period will be deposited as a Cash Settlement into your MasterCard or Visa Card Account, or if this is not possible, will vest in DonorAid.
  6. DonorAid may terminate your DonorAid Account and/or the Program for any reason at any time by giving you 7 days’ prior notice via the DonorAid website. Any Cash Reward within your DonorAid Account will be transferred as a Cash Settlement to your MasterCard or Visa Card Account.

8. Privacy

Any personal information, including your User Information, submitted by you to DonorAid is subject to and will be handled in accordance with DonorAid’s Privacy Policy. The Privacy Policy forms part of these Terms. You agree that, by accepting these Terms, using the Program or communicating with DonorAid, you have read the DonorAid Privacy Policy, understood its contents and consented to its requirements. The DonorAid Privacy Policy is available at www.donoraid.org/privacy/policy.

9. Intellectual property

All intellectual property rights (including copyright, trademarks and patents) in the Program, or any promotion of the Program by DonorAid and all components of them are owned by, commissioned or licensed by, DonorAid unless otherwise indicated. You must not copy, modify or transmit any such content except as permitted in these Terms or expressly agreed in writing by DonorAid Pty Ltd.

10. Disclaimer of warranties and limitation of liability

  1. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the or any other applicable law that cannot be excluded, restricted or modified by agreement.
  2. Subject to clause 10(a) and to the extent permitted by law, DonorAid excludes all warranties, whether express or implied, including any warranties or representations:
    1. that the Program will be rendered with due care and skill;
    2. concerning the availability of the Program; and
    3. concerning the quality, completeness, accuracy, suitability, acceptability or fitness for purpose in relation to the Program.
    4. Subject to clause 10(a) and to the extent permitted by law, the maximum liability of DonorAid and its employees, agents or contractors for any loss, damage, claim, cost or expense whatsoever arising out of or in connection with these Terms, the Program, and any services advertised or accessible using the Program will be limited to the value of any valid unredeemed Cash Reward in your DonorAid Reward Account (as determined by DonorAid) in relation to
    5. the transaction in which the claim arises. You agree to bring all claims within 3 months of the date of the transaction and to waive your rights to make such claims thereafter.
    6. DonorAid’s services come with guarantees that cannot be excluded under the ACL. You are entitled to have the services supplied again, or the payment of the cost of having the services supplied again, if the services were not rendered with due care and skill or if the services (or the products resulting from the services) were not fit for the particular purpose outlined in these Terms.
    7. For the purpose of clause 10(d), you acknowledge and agree that the services supplied by DonorAid are limited to the Program, and that the particular purpose of DonorAid’s services is limited to the purpose outlined in these Terms.
    8. To the extent permitted by law, DonorAid and its employees, agents or contractors will not be liable for any loss, damage, claim, cost or expense whatsoever arising out of the goods and services that are the subject of any qualifying purchase under these Terms.
    9. For all other claims of liability, and to the extent permitted by law, the maximum liability of DonorAid and its employees, agents or contractors will be AU$50 in the aggregate of all claims.
    10. Subject to clause 10(a) and to the extent permitted by law, DonorAid will not be liable for any loss, damage, claim, cost or expense whatsoever arising out of or in connection with these Terms, the Program, and services advertised or accessible using the Program, to the extent that such loss, damage, claim, cost or expense was caused by:
      1. you (for example, through your negligence or breach of contract);
      2. your failure to reasonably mitigate your loss; or
      3. events outside of DonorAids control.

    11. Indemnity

    You indemnify DonorAid in respect of all loss, damage, costs, expenses (including legal fees on a full indemnity basis), fines, penalties, claims, demands and proceedings howsoever arising, whether at common law (including negligence) or under statute, in connection with any of the following:

    1. any breach of these Terms by you;
    2. your use of Program (including registration);
    3. any use of your DonorAid Account, including by third parties; and
    4. any claims that may be brought against DonorAid or which DonorAid must pay, sustain or incur as a direct or indirect result of the use by DonorAid of your User Information.

    12. Force majeure

    DonorAid will not be liable to you for any delay or failure to perform its obligations under these Terms as a result of a cause beyond its reasonable control, including acts of God.

    13. Interpretation

    13.1 Definitions
    ACL means the Australian Consumer Law as found in Schedule 2 to the Competition and Consumer Act 2010 (Cth); MasterCard or Visa Card Account Card Issuer means the bank handling your MasterCard or Visa Card Account and providing your MasterCard or Visa Card;
    Cash Reward means the value of cash-back Reward that are registered to your DonorAid – It’s More Rewarding Account, based on qualifying transactions using your MasterCard or Visa Card with DonorAid Participating Merchants;
    Cash Settlement means the Australian dollar amount of any Cash Reward that is deposited into your DonorAid MasterCard or Visa Card Account in accordance with these Terms;
    Excluded Transactions means any transaction where you:

    1. draw cash from the MasterCard or Visa Card Account linked to the MasterCard or Visa Card using an automatic teller machine, at a financial institution or from a Participating Merchant;
    2. receive from a Participating Merchant a cash substitute (including, but not limited to, using your MasterCard or Visa Card to purchase gambling chips or tokens, travelers’ cheques or money orders, gift certificates or to load value to a stored value card or facility);
    3. Use the MasterCard or Visa Card Account to pay bills through a third party (such as Bpay®) where the Participating Merchant whose bill is being paid is not paid by MasterCard or Visa Card; or
    4. Use the MasterCard or Visa Card account to pay bills over the counter at a financial institution. Participating Merchants means (companies) merchants and retailers who participate in the DonorAid – It’s More Rewarding loyalty program by providing a Cash Reward.

    Privacy Policy means the DonorAid privacy policy on how it collects, uses and discloses your personal information, set out at www.donoraid.org Program means the DonorAid – It’s More Rewarding Loyalty Program;
    DonorAid means DonorAid Pty Ltd ACN 611 810 461, its controlled entities and its agent;
    DonorAid Account means your registered account with DonorAid, which enables you to use the Program and where your Cash Reward are recognised;
    DonorAid means the DonorAid – It’s More Rewarding, Loyalty Program;
    DonorAid Website means www.donoraid.org or www.donoraid.com.au ;
    DonorAid – It’s More Rewarding Website means www.itsmorerewarding.com.au or www.itsmorerewarding.com Terms means these terms and conditions of use;
    User Information means any information that DonorAid request for you to provide, including your name, email address, mobile phone contact, username and password Australia New Zealand Bank information means cardholders MasterCard or Visa Card number/s, church, charity, club or organisation donation bank account details, username and password;
    MasterCard or Visa Card means the authorised MasterCard or Visa prepaid-reloadable, debit or credit card (excluding prepaid with a unique MasterCard or Visa card number) registered to your DonorAid Account, which has been issued by an Australian Card Issuer; and MasterCard or Visa Card Account means the MasterCard or Visa account linked to your MasterCard or Visa Card by your Card Issuer.

    13.2 Jurisdiction and law
    These Terms are governed by and must be construed in accordance with the laws of the State of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of that State and the Commonwealth of Australia in respect of all matters arising out of or relating to these Terms, their performance and subject matter.

    13.3 Severability
    Each provision of these Terms is severable from the others and no severance of a provision will affect any other provision.
